Description

The course tackles law as it applies to international business transactions in the global political legal environment, it studies interrelationships among laws of different countries and the legal effects on individuals and business organizations. This course aims at enriching students’ knowledge and information with international business, its nature and its various subjects. Moreover, it focuses on the major sources of international business law and the disputes resolution mechanism used in this law to settle disputes among the involved parties. Topics include agency agreements, international contracts & administrations, regulations of exports and imports, technology transfers, regional transactions, intellectual property, product liability, and legal organization

Objectives

  • Business today is truly international, worldwide; approximately half of all business transactions are done across national borders. A firm, therefore, that chooses to ignore all but the laws and legal procedures of its own country are choosing to work half-blind. Lawyers and businesspeople have to have a basic understanding of legal systems other than their own. Therefore, by the end of this course, students should be able to:  Describe the philosophy and principles of international business law and understand the nature and major concepts of international business law.  Focus on the major sources of international business law and the disputes resolution mechanism used in this law to settle disputes among the involved parties, thus, explaining the international business law process.  Possess knowledge of the different subjects and sources of international business law. Focusing on contract agreement, negotiation, arbitration, mediation & conflict resolution.  Acquire knowledge and analysis of settlement of business disputes.  Identify the essential procedures of dispute settlement in ICSID and the WTO.  Delineate and discuss the differences between the various sources of international business law.  Analyse, evaluate and criticize the various disputes settlement mechanisms.  Develop and enhance the needed analytical skills required to understand the rationale for the arbitration awards in ICSID and the WTO.
